Terms and conditions
These Terms and Conditions (“Terms”) govern your use of the services provided by Stuhler Orthodontics (“the Practice”), operating in Kenya,and apply to all patients, clients, and visitors (“you” or “Patient”). By accessing or using our services, you agree to be bound by these Terms.
Consultations and Appointments:
Initial consultations require an upfront payment, determined and communicated to you before confirmation. You acknowledge that a stable internet connection and a device equipped with a functioning camera and microphone (e.g.,smartphone, laptop) are essential and must be prepared before the consultation.Failure to attend or arriving more than ten (10) minutes late will result in termination of the consultation with no entitlement to a refund. Any cancellations or rescheduling must be communicated at least forty-eight (48)hours in advance via email, phone, chatbot, or other communication channels as determined by the Practice. Failure to do so will incur a cancellation fee.
Payment Terms:
Payments for treatment plans and services may be made via mobile money, debit cards, or bank transfers. All fees are payable as agreed upon in advance. The Practice reserves the right to withhold treatment progression for outstanding payments.Treatment Plans and Patient Responsibilities:
The Patient agrees to adhere strictly to the treatment plan and instructions provided by the attending orthodontist. Non-compliance or failure to follow prescribed schedules may adversely affect treatment outcomes. The Patient acknowledges and accepts inherent risks linked to disregarding medical advice, which may include prolonged treatment duration or failure to achieve desired results.
Indemnification and Limitation of Liability:
The Patient agrees to indemnify, defend, and hold harmless Stuhler Orthodontics, its employees, agents, and contractors from any claims, damages,liabilities, or expenses arising out of or related to your failure to comply with treatment protocols or these Terms. The Practice disclaims liability for any complications resulting directly or indirectly from non-adherence to treatment guidance or missed appointments.
Privacy and Data Protection:
Your personal data will be handled according to the Practice’s Privacy Policy, which complies with Kenyan data protection laws and GDPR for European patients. The Privacy Policy is accessible via a separate webpage linked herein and forms part of these Terms.Dispute Resolution:
Any dispute arising out of or relating to these Terms or the provision of services will first attempt resolution through mediation. Should mediation fail, the dispute will be submitted to binding arbitration, and further unresolved disputes may be escalated to the competent courts of Kenya.
Governing Law:
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, including applicable healthcare regulations.By engaging Stuhler Orthodontics’ services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.This comprehensive Terms and Conditions balances legal protections for the Practice and clear patient obligations under Kenyan law and European data privacy standards.
